The short answerNessoo Report · nessoo.com

As of October 17, 2026, the rent freeze is in effect. Stabilized leases starting October 1, 2026 through September 30, 2027 carry a 0% increase for 1- and 2-year terms, while a Manhattan judge weighs a landlord lawsuit he has said he will decide before the end of the year.

  • →The Rent Guidelines Board adopted the 0% guideline on June 25, 2026, by a 7-1 vote.
  • →The judge declined to pause the freeze while the case continues.
  • →It covers about 1 million rent stabilized apartments.

If you live in a rent stabilized apartment, you have probably heard two things this fall.

Your rent is frozen.
And landlords are suing to undo it.

Both are true. Here is what is actually happening, and what it means for your lease, as of October 17, 2026.

What did the Rent Guidelines Board decide?

On June 25, 2026, the Rent Guidelines Board adopted its guidelines for the year. The vote was 7-1.

  1. 1-year leases. 0%.
  2. 2-year leases. 0%.
  3. Which leases. Stabilized leases starting on or after October 1, 2026 and on or before September 30, 2027.

It covers about 1 million rent stabilized apartments. It does not apply to market-rate apartments.

For comparison, the year before, the board set 3% for 1-year leases and 4.5% for 2-year leases.

Who is suing, and what do they claim?

A group of landlords, seven according to news reports, filed suit in Manhattan Supreme Court to overturn the freeze.

Their claim, in short: that the board did not act independently, and that City Hall improperly shaped the outcome.

The city’s lawyers say the board followed proper procedures and considered the data in the record.

The case is in front of Justice Brendan Lantry.

What has the judge done so far?

  1. September 2. He heard arguments from both sides.
  2. September 17. He ordered the city to turn over written communications between the Mayor’s Office and Rent Guidelines Board personnel from January 1 to June 25, 2026. Discovery like this is rare in this type of case.
  3. Late September. He declined to pause the freeze before October 1. He also declined the landlords’ request to apply last year’s 3% and 4.5% increases instead, saying he did not see authority to do that.
  4. October 1. The freeze took effect. The landlords’ lawyer filed the communications with the court and asked to question city officials under oath.

The judge has said he will decide the case before the end of the year. As of October 17, 2026, there is no ruling.

What does this mean for my lease?

Here is what I would tell any friend in a stabilized apartment right now.

  1. The freeze is the rule today. A 1- or 2-year renewal starting October 1, 2026 or later should show a 0% guideline increase.
  2. Do not miss your deadline. Your landlord has to offer your renewal 90 to 150 days before your lease ends. You have 60 days to sign and return it.
  3. You pick the term. 1 year or 2 years. That is your choice, not the landlord’s.
  4. A signed lease is a contract. That is how housing attorneys quoted in coverage of the case put it. What would happen to signed 0% leases if the freeze were overturned has not been decided.
  5. Watch for the ruling. The answer is expected before the year ends.

What does it mean for owners?

  1. Offer renewals at the current guideline. Today that is 0%.
  2. Keep your timelines. The 90 to 150 day renewal window did not change.
  3. Do not get ahead of the court. The guideline stands unless and until a court changes it.

The short version

The freeze is in effect.
The lawsuit is still open.
A ruling is expected before the end of the year.

We will update this when the court decides.

“Until a court says otherwise, the number on your renewal is 0%.”
