Rent stabilized or market rate? How to check a NYC unit.
A stabilized lease can mean a 0% renewal increase this year. Here is how to find out what you are actually renting, straight from the state.
Ask NY State Homes and Community Renewal (HCR). Tenants can request an apartment's rent history or ask "Am I rent stabilized?" through HCR's online portal, and the answer is mailed to the apartment.
- →The rent history shows the rents the owner registered with the state.
- →HCR says to expect a response in about 20 business days.
- →Stabilized renewals starting Oct 1, 2026 to Sep 30, 2027 have a 0% guideline.
Two apartments can sit on the same floor, same layout, same view.
One renews at 0% this year.
The other renews at whatever the landlord asks.
The difference is one word on paper: stabilized.
Here is how to check which one you have, using the state’s own records.
Why does it matter right now?
The Rent Guidelines Board voted a 0% increase for rent stabilized renewals. That covers 1-year and 2-year leases starting October 1, 2026 through September 30, 2027.
The board sets guidelines for about 1 million stabilized apartments in New York City.
If you are in one of them and your renewal starts in that window, the guideline for your renewal is 0%. If you are market rate, the guideline does not apply to you.
That is a big reason to know.
How do I check if an apartment is rent stabilized?
The answer lives with NY State Homes and Community Renewal, the state agency that keeps the records. Most people call it HCR or DHCR.
Here is how it works:
- Go to the Ask HCR portal. On the form, pick “Apartment Rent History” or “Am I Rent Stabilized?”
- Enter the address and unit. Street, unit, city and zip are required.
- Wait for the mail. HCR says a response will be mailed to the apartment within about 20 business days.
You can also call HCR’s Office of Rent Administration at 1 (833) 499-0343.
There is one more route. Tenants can file Form REC-1, a request for records access, by email or mail. You attach a copy of your lease, a rent receipt or a rent bill.
What does the rent history show?
Owners of rent stabilized apartments have to register each one with the state every year. The registration reflects the apartment as of April 1, and it includes the apartment’s legal regulated rent.
The rent history is that record over time. Year by year, what the owner told the state.
Owners also have to give each stabilized tenant a copy of their apartment’s registration. So if you already live there, check your paperwork.
Can I check before I sign?
This is the honest catch.
The portal mails the answer to the apartment itself. If you have not moved in yet, it is not going to you.
So before you sign, here is what I would do:
- Ask the landlord directly, in writing. “Is this unit rent stabilized?” A clear answer in writing is worth having.
- Look for the rider. HCR says a completed lease rider must be attached to every vacancy lease and renewal lease for a stabilized apartment. If the lease is stabilized, the rider should be in the packet.
- Check the building. The Rent Guidelines Board says that, in general, if a building has six or more units and is not a condo or co-op, it is worth asking HCR whether your apartment is or should be stabilized. The board also keeps a list of stabilized buildings, but it says the list is not complete and does not show which apartments are stabilized.
- Request the history once you are in. Then you have the state’s answer on file.
Here is how I see it
Most renters never check. They assume.
A request takes a few minutes. The answer can shape every renewal you sign in that apartment.
Know what you are renting.
Get it from the state.
Keep it on file.
“Don't guess what you're renting. The state keeps the receipts.”
